PLEASE READ CAREFULLY BEFORE SIGNING

In consideration of being allowed to participate in any way in martial arts training, classes, events, or other activities (collectively referred to as “Activities”) conducted or sponsored by Rochester Phoenix Martial Arts ("School"), I hereby agree and acknowledge as follows:

1. ASSUMPTION OF RISK

I understand that participation in martial arts involves physical exertion and contact, and that there are risks of serious injury or death. I voluntarily assume full responsibility for all risks, both known and unknown, associated with my participation in the Activities.

2. RELEASE OF LIABILITY

I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and hold harmless [Name of School], its owners, instructors, employees, volunteers, affiliates, and agents from any and all liability for any loss or damage, including injury or death, whether caused by the negligence of the School or otherwise, while participating in the Activities or on the premises.

3. INDEMNIFICATION

I agree to indemnify and hold harmless the School from any claims, causes of action, damages, judgments, costs, or expenses (including attorney's fees) resulting from my involvement in the Activities or presence on the premises.

4. MEDICAL AUTHORIZATION

In case of an emergency, I authorize the School to obtain medical treatment for me or my child (if applicable), and I agree to be financially responsible for any costs incurred as a result.

5. MEDIA RELEASE (Optional)

I grant the School permission to use photographs and/or videos taken of me (or my child) during Activities for promotional purposes, including social media and website use.

6. SEVERABILITY

If any portion of this agreement is found to be invalid or unenforceable, the remainder shall continue in full force and effect.

I hereby permit images or video of me or my child captured during any class, event, or activity by Rochester Phoenix Martial Arts for the sole purposes of promotional material and publications, including website, fundraising, or any other like purpose, and further give my consent for said images to be used for website and social media. And that any such photos and videos will remain the property of Rochester Phoenix Martial Arts. I hereby grant Rochester Phoenix Martial Arts permission to use mine or my child's likeness in a photograph in all publications for all purposes, including website entries, without payment or any other consideration in perpetuity. I authorize Rochester Phoenix Martial Arts to edit, alter, copy, exhibit, publish, or distribute this photo to publicize Rochester Phoenix Martial Arts programs or any other lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph. 

We respect your choice not to be photographed. 

Please let us know if you want to avoid being photographed or having your child photographed. 

We will never publish a photo of you or your child if you do not want us to do so.
